This Caahat Buyer Refund Agreement ("Agreement") is entered into by and between Caahat ("Platform" or "Caahat") and the individual or entity onboarding as an User ("Buyer") to explore and buy products on Caahat ine platform.
1.1. This Refund Policy outlines the conditions under which refunds will and will not be issued for purchases made through the Caahat platform ("Platform"). This policy applies to all purchases of personalized products from sellers ("Sellers") listed on the Platform.
2.1. Generally, all sales made through the Platform are considered final, and no refunds will be issued to buyers for the following reasons:
2.2. Change of Mind: Refunds will not be issued if a buyer changes their mind about the product, its design, or its intended use after placing an order.
2.3. Order Cancellation: Once an order is placed and confirmed, it cannot be canceled by the buyer unless expressly agreed upon by the Seller.
2.4. Delivery Delays: Delays in product delivery, unless caused by the Seller's gross negligence or willful misconduct, do not constitute grounds for a refund.
2.5. Minor Discrepancies: Minor discrepancies in the final product compared to the initial design, such as slight variations in color or size, do not warrant a refund.
Caahat recognizes that unforeseen circumstances may prevent a Seller from fulfilling an order. In such cases, where the Seller is unable to fulfill the order due to circumstances beyond their reasonable control, a full refund will be issued to the buyer.
Circumstances that may warrant a full refund include (but are not limited to):
3.1. Seller Bankruptcy or Closure: If the Seller ceases operations or becomes insolvent, preventing them from fulfilling the order.
3.2. Unforeseen Events: In the event of natural disasters, pandemics, or other unforeseen events that significantly disrupt the Seller's operations and prevent them from fulfilling the order.
3.3. Seller Fraud or Misconduct: If the Seller engages in fraudulent activities or intentionally misrepresents the product or their ability to fulfill the order.
4.1. In case of a dispute regarding a refund, the buyer and the Seller are encouraged to attempt to resolve the issue amicably through communication on the Platform.
4.2. If the dispute cannot be resolved directly, the buyer may escalate the matter to Caahat for mediation. Caahat will review the situation and make a fair and equitable determination based on the terms of this policy and applicable laws.
5.1. This Refund Policy does not limit the buyer's statutory rights under applicable consumer protection laws.
6.1. Caahat reserves the right to modify this Refund Policy at any time. Any changes to this policy will be posted on the Platform and will be effective immediately upon posting.
7.1. This Refund Policy shall be governed by and construed in accordance with the laws of India.
